These Conditions apply to the Terms & Conditions of Sale and Terms & Conditions of Installation. These Terms apply to installation services associated with your order for Products. 1. GENERAL GLOSSARY 1.1 For the purpose of these terms and conditions, the following words shall have the following meanings: 2. "Us/we" shall mean Frontal Developments Ltd 3. "Customer/you" the person or organisation for whom we agree to carry out work and/or supply materials 4. "Our representative/Fitter" shall be the person we send to you to perform the work. 1.2 You personally will be deemed to be our customer unless it is made clear to us who the customer is and we have confirmation that you have the right to instruct us on their behalf. 5. ADDITIONAL WORK REQUESTED BY CUSTOMER 2.1 For additional work required to rectify existing systems to meet current industry regulations, parts, materials, labour and VAT will be charged to the Customer with their agreement at the current rate quoted. 2.2 The total charge to the Customer will be for the time spent by our representative doing the work, plus the cost of parts and materials used. If the required materials are not available locally, they will be ordered, and any carriage or postal costs will be charged to the Customer. 6. DESIGNS 3.1 Any plan drawn by Frontal Developments Ltd remains our property and is subject to copyright. These may not be reproduced or used, in whole or part, by any other party without our written consent. Where a specifically designed plan is provided, the Customer agrees to check its accuracy and suitability. Illustrations may include items such as plants or appliances for realism, but these are not included in the order. A copy of the designs may be provided at the quotation stage for a non- refundable fee of £100, which will be refunded only if the order is confirmed and a deposit placed. 3.2 The Customer must confirm that all items and design layouts quoted and ordered meet their requirements. Quotations based on Customer-provided details are subject to the accuracy of those details. We accept no responsibility for inaccuracies in measurements or information provided by the Customer. 3.3 Measurements are taken from accessible and visible parts of the room and include standard tolerances. If, upon removal of existing fixtures, it becomes apparent that structural irregularities exceed these tolerances, the Customer is responsible for costs incurred to correct them or adjust unit sizes accordingly. 3.4 No liability is accepted for any consequential loss or damage. 3.5 While every effort is made to produce realistic visuals, discrepancies in colour, finish, and installation may occur. 3.6 Modifications may be necessary during fitting due to unforeseen restraints. Any such changes will be communicated to the Customer as early as possible. 7. QUOTATIONS 4.1 Quotes will include labour and materials plus VAT. Prices are fixed except in cases of manifest error. Revisions may be required if the scope of work changes, material costs increase, or additional work is necessary. 4.2 Quotations remain open for acceptance for 14 days. Assumptions include:  Work is conducted during normal working hours (8:00 a.m. to 6:00 p.m., Monday to Friday);  Unrestricted access to the worksite;  Full accessibility to all relevant areas. 4.3 Acceptance of a quotation confirms the Customer's compliance with applicable regulations and acquisition of all necessary permissions and licenses. 4.4 A non-refundable deposit is required to secure kitchen installation services, which will be deducted from the final bill. 4.5 To hold a specific installation date without placing a full order, a non-refundable deposit of £1,500 is required. Three weeks' written notice is required for any changes to the date; otherwise, the deposit will be forfeited as loss of earnings. 4.6 Unless agreed otherwise, redundant materials remain the Customer's property. If agreed, we will remove them, assuming ownership and responsibility for their disposal in compliance with legal requirements. 4.7 For supply-only kitchens, delivery will be direct from the supplier. The Customer must check items and report any defects within 72 hours of delivery. Failure to report within this time may result in additional charges. We are not responsible for inspecting deliveries unless providing full supply and installation services. 5. PRE-INSTALLATION 5.1 Upon acceptance, we will conduct a pre-fit survey to confirm final measurements and identify any supplementary work required. The cost of such work will be confirmed in writing. 5.2 The Customer is not obligated to use us for supplementary work. We accept no liability for damage arising from work performed by third-party subcontractors. 5.3 The final plan forms the basis for installation. The Customer must approve any changes before signing off on the plan. YOUR RESPONSIBILITIES 6.1 The Customer is responsible for: 7. Ensuring accurate measurements; 8. Obtaining all permissions and consents; 9. Providing clear, safe access to the site; 10. Disconnecting any affected services; 11. Ensuring the area is clean, level, and clear; 12. Providing power, lighting, and heating; 13. Informing us of property changes; 14. Disposing of packaging unless otherwise agreed. 6.2 Subcontracted supplementary work must be carried out with reasonable skill and care. 6.3 If poor supplementary work prevents installation, we may: 15. Rectify the work at your cost; 16. Reschedule the installation. You are responsible for suitable storage of Products and for any resulting losses or damages. 6.4 Installation must be rescheduled within 3 months, or it will be deemed cancelled. 6.5 Delivery and installation must occur at the same location unless otherwise agreed. 6.6 The Customer must notify us of any structural issues that may affect the work. 6.7 Deviations from the plan agreed with the Fitter are the Customer's responsibility. 6.8 Any concerns during installation must be raised immediately. 6.9 A completion certificate must be signed upon conclusion. Issues must be documented at that time. 6.10 We must be granted access to assess any claims related to installation. 17. INSTALLATION PROCESS 7.1 We aim to complete installation promptly but do not guarantee specific completion dates. 7.2 Provided the Customer meets their obligations, our standard installation includes: 18. Assembly and fitting of kitchen cabinets and related components; 19. Basic appliance fitting (excluding connections); 20. Worktop fitting with necessary cut-outs; 21. Sink and tap installation; 22. Sealing of joins and cut-outs. Sealant colour is at our discretion unless specified. 7.3 We reserve the right to suspend work if structural or utility issues arise. 7.4 We are not responsible for any issues arising from faulty or poor-quality structures or utilities. 7.5 Customers should protect their property from dust and disruption. We will not be liable for cleaning costs. 7.6 Minor damage to decor is not our responsibility unless due to negligence. 23. TIMEKEEPING 8.1 While we strive to meet agreed times, we accept no liability for delays. 24. PAYMENT 9.1 Invoices are due immediately upon delivery. Late payments may incur interest at 4% above HSBC Bank base rate (per month for consumer contracts), or in accordance with statutory and commercial guidelines for business contracts. 25. COMPENSATION & OWNERSHIP 12.1 No compensation will be offered for any delays, damages, or disruptions unless caused by our proven negligence. 12.2 All Products and materials remain the property of Frontal Developments Ltd until the final balance has been paid in full. We reserve the right to recover goods not paid for in full. 26. GENERAL NOTES 11.1 We reserve the right to refuse any work. 11.2 We reserve the right to choose our representatives. 11.3 For bathroom installations, adequate extraction (e.g., extractor fans) must be installed. Failure to do so may void furniture warranties. Disputes are subject to the jurisdiction of English Courts. 11.7 We aim to resolve issues directly. If unresolved, the Consumer Ombudsman may assist. 11.8 If any provision is deemed unlawful or unenforceable, it will be severed, and the remaining terms will continue in effect.
